There is hereby established a board to be known as the Protection
of

PART IV FINANCIAL PROVISIONS

PART V PAYMENT FROM THE FUND

Subject to this Part, an applicant to whom--

Payment
Subject to subsections (1B) and (2) where it appears

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

Where the Commissioner exercises his discretion under
subsection (1)

For the purpose of verifying any application under section 15,

广西壮族自治区人民政府关于印发广西壮族自治区学校幼儿园及周边治安综合治理暂行办法的通知

各市、县人民政府,自治区农垦局,自治区人民政府各组成部门、直属机构:
现将《广西壮族自治区学校幼儿园及周边治安综合治理暂行办法》印发给你们,请认真组织实施。

广西壮族自治区学校幼儿园及
周边治安综合治理暂行办法
第一条 为维护学校、幼儿园及周边治安秩序,优化育人环境,保持良好的教学、科研和生活秩序,确保我区学校的安全稳定,根据《中华人民共和国教育法》、《中小学幼儿园安全管理办法》(教育部令第23号)、《学生伤害事故处理办法》(教育部令第12号)及有关法律、法规、政策,制定本办法。
第二条 本自治区行政区域内的各级各类学校、幼儿园及周边治安环境管理均适用本办法。
本办法所称学校、幼儿园及周边治安环境是指学校、幼儿园及周边辐射200米以内存在的治安问题或可能引起治安问题的场所、设施、秩序、人员等综合环境。
第三条 自治区、市、县(市、区)设学校、幼儿园及周边治安综合治理工作领导小组(以下简称“领导小组”),成员单位由同级教育、综治、公安、民政、司法、财政、建设、交通、文化、卫生、工商、新闻出版、食品药品监督、通信管理、共青团等部门组成,领导小组办公室设在同级教育部门。各级领导小组及办公室负责组织协调和督促检查同级有关部门和单位在各自职责范围内,依照本办法的规定对学校、幼儿园及周边治安环境实行综合治理。
第四条 学校、幼儿园及周边治安综合治理工作坚持“属地管理”和“谁主管,谁负责”的原则。各级教育、综治、公安、民政、司法、财政、建设、交通、文化、卫生、工商、新闻出版、食品药品监督、通信管理、共青团等部门在本级党委、政府的领导下,依照本办法履行学校、幼儿园及周边治安综合治理的职责。
社会团体、企事业单位、其他社会组织和个人应当积极参与和支持学校、幼儿园及周边治安综合治理工作,共同维护学校安全稳定。
第五条 学校、幼儿园及周边治安综合治理工作的主要任务:
(一)落实学校、幼儿园及周边治安综合治理领导责任制、目标管理责任制,建立校地共建、齐抓共管的长效机制。
(二)强化学校、幼儿园及周边治安综治工作,及时排查消除各类治安隐患和不稳定因素,开展专项整治和集中行动,建立健全长效机制,维护学校、幼儿园及周边安全稳定。
(三)依法查处打击侵害学校、幼儿园及师生人身权利、财产权利等合法权益的各类违法犯罪活动和学校、幼儿园及周边地区存在的黑恶势力犯罪;加强学校、幼儿园及周边娱乐服务场所的治安管理,坚决铲除“黄、赌、毒”等社会丑恶现象;强化学校、幼儿园及周边文化市场日常监管,严厉打击学校、幼儿园及周边文化经营单位违法违规经营行为;坚决取缔学校、幼儿园及周边地区非法经营的互联网上网服务营业场所(以下简称“网吧”)、电子游戏厅、歌舞厅、音像书刊点、按摩室、发廊、浴室和无证及占道经营的摊点,依法清理整顿出租房屋和拆除违章建筑等;整顿学校、幼儿园及周边地区的交通秩序,严厉查处影响师生出行安全的“黑出租”、“黑校车”,加强交通管理;严厉查处社会上损害师生利益的非法办学和非法招生中介机构;对学校及周边地区外来人口进行清理登记,规范管理;规范和加强对校外住宿学生及校外学生公寓的管理;定期和不定期地对学校内部进行安全检查,督促其整改各类不安全隐患,坚决杜绝火灾、建筑物倒塌、拥挤踩踏和食物中毒等各类事故的发生。
第六条 学校、幼儿园及周边治安综合治理工作实行日常管理、专项整治和集中行动相结合的方式方法。
日常管理是指各部门和单位及有关责任人按照校地共建机制,对学校、幼儿园及周边治安环境责任区进行管理。
专项整治是指某一个或几个部门和单位针对一定区域内某一所或几所学校、幼儿园周边存在的突出治安问题或隐患进行专项清理整治行动。
集中行动是指各级领导小组在一定时期内组织各成员单位,对辖区内学校、幼儿园及周边存在的治安问题或隐患进行全面清理整治的集中统一行动。
第七条 各市、县(市、区)在定期排查矛盾纠纷和治安隐患的基础上,对发现的问题逐一登记建档、跟踪督办,按照“定部门、定学校、定任务、定人员、定时间、定效果”的要求,落实到成员单位、有关学校和责任人;针对存在的突出治安问题,及时开展专项整治和集中行动。
各地每年应当定期或不定期开展两次以上集中整治活动。3-5月为春季集中整治时间,9-11月为秋季集中整治时间。
第八条 各成员单位和部门的主要职责任务:
(一)领导小组的主要职责:加强对学校、幼儿园及周边治安综合治理工作的领导和协调;研究解决学校及周边治安综合治理工作中的突出问题及重大事项;指导和督促检查本级学校及周边治安综合治理各项工作措施的落实,总结交流工作的成功经验,推动学校及周边治安综合治理工作的深入开展。
(二)领导小组办公室:贯彻落实各级党委、政府关于加强学校、幼儿园及周边治安综合治理的部署要求,根据自治区综治委和领导小组的部署,承担本级领导小组的日常工作(包括:学校、幼儿园及周边治安综合治理工作中的文件收发、会务筹备、档案管理、简报、大事记编写等日常工作);掌握、研判本地区学校、幼儿园及周边综治形势,定期或不定期组织全体领导小组成员会议,向领导小组汇报本级学校及周边综治工作情况,提出学校、幼儿园及周边治安环境集中整治和健全长效机制的意见及建议,并受领导小组委托协调处理学校、幼儿园及周边治安综合治理工作中所涉及的相关事项;定期或不定期召开学校、幼儿园及周边治安综合治理工作领导小组成员单位联络员会议,研究本地区学校、幼儿园及周边治安综合治理工作中的难点问题,并制定相应对策措施;有计划地组织有关部门开展学校、幼儿园及周边治安整治活动;加强与上级学校、幼儿园及周边治安综合治理工作领导小组办公室的联系,及时报送工作情况;对下级学校及周边治安综合治理工作情况进行督导和检查;及时总结、推广学校、幼儿园及周边治安综合治理工作的经验,树立、表彰先进典型;开展学校、幼儿园及周边治安综合治理工作情况调查和理论研究。
(三)教育部门:指导和督促下级教育行政机构和学校做好学校、幼儿园及周边治安综合治理工作,落实教育部为进一步做好学校安全工作的六条措施,并将学校、幼儿园及周边综治工作列入对下级教育行政机构和各级各类学校考核的重要内容;加强学校、幼儿园及周边治安综合治理基层基础工作,完善学校安全稳定工作制度;深化“平安校园”和“安全文明校园”创建活动,推进校园治安和防控体系建设,落实校园安全管理防控措施;会同有关部门加强校园及周边综合治理的突出问题的整治;完善校园矛盾纠纷排查化解机制,指导学校、幼儿园深入开展“两个排查”,有效化解学校、幼儿园及周边矛盾和问题,增加校园和谐因素;发挥学校教育特点,指导各级各类学校认真开展法制教育、公共安全教育和国家安全教育,加强防灾减灾应急演练,全面提高师生安全意识、法制意识、自我保护意识和自救逃生能力,防范校园内违法犯罪案件的发生;加强安全保卫队伍建设和应急管理队伍培训,完善各种应急预案,不断提高学校、幼儿园安全保卫工作水平。完成学校、幼儿园及周边治安综合治理工作领导小组交办的各项任务。
(四)综治部门:将学校、幼儿园及周边治安综合治理工作纳入本级社会治安综合治理工作统筹安排,充分发挥社会治安综合治理大平台作用,指导、协调各有关部门充分发挥职能作用,加强各成员单位的组织、协调和督查工作,增强各成员单位齐抓共管合力。把学校、幼儿园及周边治安综合治理工作作为年度综治工作考评的重要内容,加大评分权数,促使各项工作措施落实到位。完成学校、幼儿园及周边治安综合治理工作领导小组交办的各项任务。
(五)公安部门:认真落实公安部《公安机关维护校园及周边治安秩序八条措施》,定期排查学校、幼儿园及其周边的治安隐患,对学校、幼儿园及其周边地区治安突出问题、热点问题,适时组织有针对性的集中整治行动,严厉打击侵害师生人身财产安全的各类违法犯罪活动;指导和督促学校、幼儿园建立健全各项内部安全防范制度,开展安全检查,督促整改安全隐患,确保内部安全;在学校周边治安复杂地区设立治安岗位,有针对性的开展治安巡逻,强化治安管理;根据需要指导学校、幼儿园配备校园保安人员,负责维护校园安全;加强校车管理,认真开展校园交通秩序及运送学生车辆整治;派出所及责任区民警要落实与中小学校、幼儿园固定的联系制度和学校法制副校长及辅导员制度,深入开展法制教育、安全防范教育和禁毒宣传教育;加强学校、幼儿园周边治安秩序的整治,会同职能部门联合整治学校周边“三乱”行为,为有关部门的整治工作提供执法保障;加强互联网上以学校和学生名义的网站、贴吧以及各种娱乐场所、电子信息产品的监管,坚决打击利用互联网和手机短信造谣煽动师生非法聚集、上访等违法行为;加强学校、幼儿园周边流动人口、暂住人口和出租房屋的管理。
(六)民政部门:负责做好福利彩票经营的监督管理和巡查工作,对违反规定距离标准在中小学校周边开设福利彩票经营场所的申请一律不予核准。负责加强对弱势人群的救助。协助有关部门对流浪乞讨精神病人实施救助,按照救助管理相关规定负责将已救治的流浪乞讨精神病人接回或护送回原籍;对无法查明其亲属或者所在单位,也无法查明其户口所在地或住所地的,及时提出安置方案,报同级政府给予安置。
(七)司法部门:负责指导学校及周边治安综合治理法制宣传教育工作。充分发挥中小学法制副校长、法制辅导员的作用,加强业务培训和法律咨询服务活动,努力提高学校师生及依法治校涉及相关人员的法律素质,积极推动依法治校管理水平,参与妥善调处学校及周边地区的矛盾纠纷,为维护学校及周边治安秩序营造良好的法治氛围。
(八)财政部门:按照财政预算管理的有关规定,做好校园及周边治安综合治理工作相关经费保障工作。统筹安排学校、幼儿园及周边治安综合治理工作所需资金,并按计划及时划拨;监督检查学校、幼儿园及周边治安综合治理经费使用情况,为学校、幼儿园及周边治安综合治理机构和部门提供经费保障。
(九)住房和城乡建设部门:负责学校、幼儿园及周边建筑项目的规划管理和建设管理,将治安、消防、交通等城市基础设施建设与学校、幼儿园的规划建设统筹考虑列入总体规划;将必要的治安防范设施纳入学校建筑设计范围并严格监管;加强对青少年活动场所用地的规划管理,加强对学校、幼儿园及周边建筑工程安全管理的执法检查,依法及时拆除学校、幼儿园周边的各种违章建筑,督促房屋所有权人及时加固、修缮和治理危险房屋;指导和监督中小学燃气、供热等基础设施的建设及安全运营;加强校园周边市容环境管理,促进学校、幼儿园及周边治安环境不断好转。
(十)交通部门:会同建设部门分别负责学校、幼儿园周边的公路和城市道路交通安全设施的设置管理。在学校门前道路设置规范的交通警示标志、施划人行横道以及其他必要的设施等。配合地方政府严厉打击“黑校车”、“黑出租”等违法营运行为,特别是农村地区非法营运车辆运送学生活动。
(十一)文化部门:负责学校、幼儿园及周边文化市场的管理工作。加强学校及周边地区的文化娱乐场所、网吧、游戏机室的准入审批、监督管理,配合工商、公安和通信管理部门取缔中小学校周围200米以内的网吧、电子游戏经营场所,严肃查处接纳未成年人的文化娱乐场所。打击各种涉及反动、淫秽、色情、暴力内容的文化经营活动,净化校园周边环境;支持学校组织开展各种有益的文化艺术活动,鼓励和倡导各专业艺术表演团体举办学生专场演出,为青少年学生提供优秀的精神食粮,陶冶学生的情操。
(十二)卫生部门:加强对学校卫生防疫工作的指导,及时监测和防范各种突发性、流行性、传染性疾病的发生,严防发生因饮用水污染等原因造成疫病传播的学校公共卫生事件;依法查处各类违反《中华人民共和国传染病防治法》和《学校卫生工作条例》等法律法规的行为。配合教育部门加强宣传和培训工作,提高学校负责人和具体管理人员饮用水卫生和传染病防控安全意识和管理能力;协助学校及时做好疾病传染等安全事故的救治工作。
(十三)工商行政管理部门:负责学校、幼儿园及周边经营单位营业执照的核准工作和市场管理工作。配合公安部门维护好市场的治安秩序。配合文化、新闻出版等部门开展“扫黄打非”行动。严格审批制度,把好市场准入关,加强对学校、幼儿园周边地区文化娱乐和服务业市场及其他商业网点的巡查,规范经营范围和市场秩序。
(十四)新闻出版部门:要引导、组织新闻出版单位多出有利于青少年学生健康成长的出版物;与教育管理部门配合,指导督促各类学校加强对订购、使用教材、教辅读物的管理;加强对学校及周边地区印刷复制企业的管理,
严厉打击非法印制活动;负责牵头深入开展“扫黄打非”工作,加强校园及周边出版物经营场所巡查,重点清查校园周边出版物零售、租赁摊点和互联网上网服务经营场所,坚决查缴政治性非法出版物,以及淫秽色情、凶杀暴力、封建迷信及伪科学内容的各类书刊、音像制品、电子出版物和游戏软件;严厉打击通过互联网、网吧、录像厅、手机短信等传播淫秽色情的各种文化垃圾和有害信息的行为,净化青少年学生健康成长环境。
(十五)食品药品监督管理部门:加强对学校食堂食品安全工作的指导,加强对学校、托幼机构的食堂、学校周边餐饮服务单位食品安全的监督检查,严格审批学校、幼儿园及周边各种餐饮服务单位的餐饮服务许可证,开展经常性查验工作,督促学校食堂和相关餐饮服务单位落实各项食品安全管理制度措施,严防学校、幼儿园食物中毒事件的发生;配合教育部门加强宣传和培训工作,提高学校、幼儿园负责人和具体管理人员食品安全意识和管理能力。
(十六)通信管理部门:加强对电信业务经营者的管理,严格网吧接入的手续,认真执行《互联网上网服务营业场所管理条例》和《互联网信息服务管理办法》,积极配合相关部门开展网吧管理工作,对于工商、文化、公安等部门查处的“黑网吧”及违规经营的网吧,及时通知电信运营企业中止或终止其接入服务。配合相关部门集中打击淫秽色情网站、性药品广告网站等危害青少年学生健康成长的专项行动,努力净化互联网络环境;配合公安部门加强互联网的监管,坚决打击利用互联网和手机短信造谣煽动等行为,及时消除不利于师生健康成长和不利于校园安全稳定的不良因素。
(十七)共青团组织:认真宣传贯彻《未成年人保护法》和《预防未成年人犯罪法》,推动青少年法律法规和政策体系的完善,协调有关部门针对预防青少年学生违法犯罪领域的突出问题,适时开展专项督查和整治;加强学校团、队组织的建设;配合学校加强青少年学生的思想品德、法制教育和安全防护教育。积极组织和引导青少年学生参加青年志愿者活动和社会实践活动,参与安全文明校园和安全文明社区创建活动。落实预防和减少青少年违法犯罪的各项措施,增强学生对社会不良现象的免疫力,维护未成年人的合法权益。
(十八)街道办、村委会负责学校、幼儿园周边社区、村庄治安治理工作。大力推进治安综合治理到村入户进社区,落实群防群治措施,做好矛盾纠纷的排查和调处工作,确保学校、幼儿园周边社区、村庄治安稳定。
(十九)学校、幼儿园负责校(园)内的安全保卫及政治稳定工作。学校应当建立治安综合治理工作领导机构,实行校(园)长负责制。建立健全校(园)内综合治理工作各项责任制度和各类应急机制;建立健全校(园)安全保卫制度,配备相应的专(兼)职安全保卫人员;建立校(园)外人员入校登记或者验证制度,禁止无关人员和校(园)外机动车入内,禁止将非教学用易燃易爆物品、有毒物品、动物和管制器具等危险物品带入校园。切实加强学生宿舍和校外学生公寓管理,定期、不定期排查校园内的矛盾纠纷和治安隐患,防患于未然。中小学校要配齐兼职法制副校长。大力开展创建安全文明校园活动,努力优化学校育人环境。
第九条 有关部门和学校、幼儿园违反本办法规定或执行不力,造成学校、幼儿园及周边地区治安秩序混乱,严重影响学校、幼儿园正常教学、科研和生活秩序,严重危害师生人身及财产安全并产生严重后果的,由地方社会治安综合治理委员会给予一票否决,同时追究主要领导、分管领导和直接责任人的责任。
第十条 学校、幼儿园及周边治安综合治理工作纳入各级地方社会治安综合治理工作考核体系。地方有关责任人未尽职尽责造成严重后果的,由上级学校、幼儿园及周边治安综合治理工作领导小组办公室下达整改通知、建议给予一票否决或者建议纪检监察部门追究相关责任人的纪律责任、行政责任。
第十一条 各地可根据本暂行办法,结合本地实际,制定实施细则。
本办法自颁布之日起施行。
